SparSync (“SparSync,” “we,” “us,” or “our”) provides marketing automation, website creation, and AI receptionist services to martial arts gym owners (“you” or “user”). By accessing our website at sparsync.net, submitting a form, booking a call, or using any of our services, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree to these terms, do not access our website or use our services.

These Terms apply to all visitors, users, and others who access or use our services. If you are entering into these Terms on behalf of a business, you represent that you have the authority to bind that business to these Terms.

We offer the following services to qualified martial arts gyms:

• Custom website creation and hosting
• Missed call text-back automation
• Google review request automations
• AI receptionist and lead-nurturing SMS sequences
• Local SEO and organic growth support

The initial website build and 30-minute demo call are provided at no cost. Ongoing automation services are offered at a separate, agreed-upon monthly rate with no long-term contract required. Specific deliverables, timelines, and pricing for ongoing services are set out in a separate agreement.

By providing your mobile phone number and checking the consent box on our contact form, you agree to receive recurring SMS messages from SparSync related to your inquiry, demo call scheduling, service updates, and follow-up communications.

Message frequency

Message frequency varies depending on your interactions with us. You may receive up to several messages per week regarding your account, appointments, and service notifications.

Message & data rates

Standard message and data rates may apply from your wireless carrier. SparSync does not charge you directly for SMS messages.

Opt-out instructions

You may opt out of SMS communications at any time by replying STOP to any message. You will receive one final confirmation message, and no further messages will be sent unless you opt back in.

Carrier liability disclaimer

Wireless carriers are not liable for delayed or undelivered messages. SparSync is not responsible for carrier delivery failures or delays.

Consent is not a condition of purchase

Providing your phone number and consenting to SMS messages is not a condition of any purchase or service. You may decline to provide consent and still request information by email or phone.

Carrier and program terms

SMS messages are delivered through U.S. carrier networks under the A2P 10DLC (Application-to-Person 10-Digit Long Code) framework. SparSync participates in The Campaign Registry (TCR) process and complies with carrier messaging guidelines. We will not send marketing messages to numbers on a carrier block list or that have opted out. For details on how we handle your SMS data, see our Privacy Policy.

You agree to provide accurate, current contact information, including a valid mobile number you own or are authorized to use. You are responsible for maintaining the accuracy of your information and for any activity conducted under your account.

You must obtain proper consent before sharing any contact information (such as your students' or parents' phone numbers) with SparSync for use in review or follow-up automations, and you must comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and A2P 10DLC carrier requirements.

You agree not to:

• Use our services for any unlawful purpose or in violation of any local, state, or federal law
• Submit phone numbers without the owner's consent
• Attempt to access, alter, or disrupt our systems or another user's account
• Use SMS messaging to send deceptive, abusive, or harassing content
• Resell or sublicense our services without written permission

All website content, branding, software, and materials created by SparSync remain our intellectual property unless otherwise agreed in writing. Custom website content you provide (logos, photos, program details) remains your property, and you grant us a license to use it solely to build and operate your site and automations.

Services are provided “as is” and “as available.” We do not guarantee specific business results, lead volumes, or search rankings. Marketing outcomes depend on many factors outside our control, including your market, pricing, and operations.

To the maximum extent permitted by law, SparSync shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim is limited to the amount you have paid us in the preceding 12 months.

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes will be resolved in the courts located in Arizona.
